Terms of Service for Webhood Cloud

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Webhood Cloud services ("Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Definitions

Webhood: The company providing the Services: ST4 CYBER OY，business ID 34124378, registered in Finland.
Webhood Cloud: The cloud-based services
User: Any individual or entity that accesses or uses the Services.
Account: The account created by a User to access the Services.
Subscription: The subscription plan selected by a User to access the Services.
Content: Any data, information, or material uploaded, stored, or transmitted through the Services.
Intellectual Property: Any patents, trademarks, copyrights, trade secrets, or other intellectual property rights.
Target: The website or application that is scanned by the Services.

3. Account Registration

To access the Services, you must create an Account. You agree to provide accurate and complete information during the registration process. You are responsible for maintaining the security of your Account and for all activities that occur under your Account.

We may need to request additional information to verify your identity or to comply with legal requirements. You agree to provide this information promptly upon request.

You must be at least 18 years old to create an Account.

4. Subscription

To access certain features of the Services, you may need to purchase a Subscription. Subscriptions are billed on a monthly or annual basis and are non-refundable. You may cancel your Subscription at any time. You may be eligible to request a refund based on payment type:

Stripe: Refunds are processed through Stripe. You may select the refund option in the Stripe dashboard.
Invoicing: Subscription will remain active until the end of the billing period. No refunds are provided for invoicing.

When your register an Account, we will provide you with a free trial period. The free trial period will last for 14 days. After the free trial period, you will be required to purchase a Subscription to continue using certain Services. If you do not purchase a Subscription, the Content which does not fall into the unpaid subscription types will be deleted. You may not create multiple Accounts to extend the free trial period.

5. Use of Services

You agree to use the Services in compliance with all applicable laws and regulations. You may not use the Services to engage in any illegal or unauthorized activities. You are responsible for all Content uploaded, stored, or transmitted through the Services.

You may not use the Services to:

Upload, store, or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Upload, store, or transmit any Content that infringes on any Intellectual Property rights.
Attempt to gain unauthorized access to the Services, Targets or any other User's Account.
Use the Services to send unsolicited messages or spam.
Use the Services in a manner that could damage, disable, overburden, or impair the Services.
Use the Services to intentionally interfere with Targets, perform denial-of-service attacks, violate or attempt to bypass Targets' terms of services or otherwise disrupt the normal operation of Targets.

The Services may be subject to limitations, such as scan limits, concurrent scan limits, and other restrictions. You agree to comply with these limitations.

The inteded use of the Services is to scan websites and applications for analyzing potential phishing sites to protect Users from cybersecurity threats. You may not use the Services for any other purpose without prior written consent from Webhood including any offensive cybersecurity uses, such as social engineering and information gathering or non-cybersecurity uses cases including web scraping.

You may not resell, sublicense, or otherwise transfer the Services to any third party without prior written consent from Webhood.

6. Intellectual Property

Webhood retains all rights, title, and interest in and to the Services, including all Intellectual Property rights. You may not copy, modify, distribute, or create derivative works based on the Services.

7. Termination

Webhood may terminate your access to the Services at any time for violation of these terms. Upon termination, your Account and all Content will be deleted. Webhood is not liable for any loss of Content resulting from termination.

8. Limitation of Liability

Webhood is not liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of the Services. In no event shall Webhood's liability exceed the amount paid by you for the Services.

9. Governing Law

These Terms are governed by the laws of the Republic of Finland. Any disputes arising under these Terms shall be resolved in the state or courts located in Helsinki, Finland.

10. Changes to Terms

Webhood may update these Terms from time to time. You are responsible for reviewing the most current version of the Terms. Your continued use of the Services after any changes to the Terms constitutes acceptance of those changes.
